Jahciba Shoy has been granted bail following the dismissal of murder charges against him, after the prosecution filed notice of its intention to appeal the High Court's ruling.

According to Antigua Observer, the High Court granted Shoy bail in the sum of $10,000 with two sureties on Tuesday. The bail conditions do not require a cash deposit.

Although the charges were dismissed last week, Shoy was not immediately released. The prosecution's filing of a notice of intention to appeal the ruling kept him in custody until he exercised his right to apply for bail, which the court subsequently granted.

Defence attorney Wendel Alexander had argued before the court that the prosecution's evidence was too weak to support a conviction, amounting to no more than suspicion and speculation. Alexander further submitted that it would be unsafe to leave the matter to a jury. The presiding judge agreed, upholding the no-case submission.

The charges stemmed from the fatal shooting of 25-year-old Syrian national Roudi Shmaly during a robbery at the Pick 'n Mix Mart on DeSouza Road in May 2023.
