Jahciba Shoy has been released on $10,000 bail after prosecutors signalled their intention to appeal the High Court's dismissal of the murder case against him, according to Antigua News Room.
The High Court granted Shoy bail on Tuesday, requiring two sureties but no cash deposit. Although the murder charge was dismissed last week, he had remained in custody after prosecutors immediately filed a notice of appeal, temporarily delaying his release while permitting him to apply for bail.
The trial judge upheld a no-case submission brought by defence attorney Wendel Alexander, who argued that the prosecution's evidence amounted to no more than suspicion and speculation, and was insufficient to support a conviction. The judge agreed, ruling that the Crown had failed to establish a case for Shoy to answer.
Shoy had been charged in connection with the May 2023 fatal shooting of 25-year-old Syrian national Roudi Shmaly during an armed robbery at Pick 'n Mix Mart on DeSouza Road.
The matter now moves to the Court of Appeal, which will determine whether the High Court was correct to dismiss the case or whether further proceedings should follow.
