A High Court judge is deliberating on a landmark case challenging the legality of the Barbuda airport development after environmental activist John Mussington and Barbuda Council member Jackie Frank concluded their long-running legal battle this week.
According to Antigua News Room, the pair — backed by the Global Legal Action Network (GLAN) — argue that the project proceeded without proper environmental approvals, adequate public consultation, or lawful planning procedures. They contend that Barbudans were denied meaningful input before construction began.
Following the hearing, Frank expressed confidence that the ruling would favour Barbuda.
The case has drawn significant international attention, particularly in the wake of a 2024 Privy Council ruling that affirmed Mussington and Frank's legal standing to bring the challenge. That ruling cited Antigua and Barbuda's obligations under the Escazú Agreement.
GLAN has argued that the airport — partly funded by developers linked to luxury tourism projects — poses a threat to Barbuda's environment. The organisation contends the case sets an important precedent for environmental justice and public participation across the Caribbean region.
The High Court's pending decision could carry far-reaching implications for future development approvals and environmental protections throughout Antigua and Barbuda.
